los compañeros de Telefónica <FONT color=#ff0000>100 organizaciones, toda la
izquierda y sindicatos de Catalunya manifiesta: <?XML:NAMESPACE PREFIX = O

<P class=MsoNormal><B style="mso-bidi-font-weight: normal"><SPAN lang=ES-TRAD
style="FONT-SIZE: 13pt; mso-ansi-language: ES-TRAD">Desde el lunes, 5 de
noviembre, cinco trabajadores de Telefónica están en huelga de hambre por la
readmisión de uno de ellos, despedido por “no ser rentable” al tener bajas
médicas justificadas.<O:P></O:P></SPAN></B></P>
<P class=MsoNormal><SPAN lang=ES-TRAD
style="FONT-SIZE: 13pt; mso-ansi-language: ES-TRAD">Después de más de tres
semanas en huelga de hambre la salud de los mismos se está resintiendo
gravemente. Uno de ellos ya ha tenido que abandonar la huelga por decisión
médica.<B style="mso-bidi-font-weight: normal"><O:P></O:P></B></SPAN></P>
<P class=MsoNormal><SPAN lang=ES-TRAD
style="FONT-SIZE: 13pt; mso-ansi-language: ES-TRAD">El despido fué sentenciado,
primero nulo y después improcedente. Este improcedente permitía a Telefónica
despedir al trabajador con una indemnización. <O:P></O:P></SPAN></P>
<P class=MsoNormal><SPAN lang=ES-TRAD
style="FONT-SIZE: 13pt; mso-ansi-language: ES-TRAD">Así están las leyes: una
persona que ha sido declarada inocente puede ser despedida. Con la circunstancia
vergonzosa, además, de que la propia sentencia declara que Telefónica ha
pretendido aplicar una ley con carácter retroactivo, vulnerando así el artículo
9.3 de la Constitución.<O:P></O:P></SPAN></P>
<P class=MsoNormal><SPAN lang=ES-TRAD
style="FONT-SIZE: 13pt; mso-ansi-language: ES-TRAD">La ley, que ampara y obliga
a todos los ciudadanos, no traspasa el muro de las
empresas.<O:P></O:P></SPAN></P>
<P class=MsoNormal><SPAN lang=ES-TRAD
style="FONT-SIZE: 13pt; mso-ansi-language: ES-TRAD">Es en una situación de
crisis aguda cuando las injusticias se hacen más insoportables (despidos,
desahucios, estafas bancarias…) y cuando se manifiesta en toda su crudeza el
poder abusivo de las grandes empresas.<O:P></O:P></SPAN></P>
<P class=MsoNormal><B style="mso-bidi-font-weight: normal"><SPAN lang=ES-TRAD
style="FONT-SIZE: 13pt; mso-ansi-language: ES-TRAD">Por ello, las organizaciones
firmantes, nos comprometemos, en la medida de nuestras posibilidades, a mediar,
negociar, luchar para conseguir los cambios legislativos necesarios para
que:<O:P></O:P></SPAN></B></P>
<P class=MsoNormal><B style="mso-bidi-font-weight: normal"><SPAN lang=ES-TRAD
style="FONT-SIZE: 16pt; mso-ansi-language: ES-TRAD">1º) Telefónica readmita a
los despedidos por bajas médicas justificadas, como es el caso de

style="FONT-SIZE: 16pt; mso-ansi-language: ES-TRAD">2º) Ningún trabajador con

izquierda de los parlamentos catalán y español, prácticamente todos los
sindicatos, y numerosas entidades sociales. También hubo buena presencia de

comprometido a realizar una mediación con la dirección de Telefónica, para que

mediación que emplaza a Telefónica a solucionar el conflicto laboral creado por
el despido de Marcos. Con la esperanza depositada en esta mediación, dejamos la
huelga de hambre que hemos mantenido durante 23 días.<o:p></o:p></SPAN></P>
