23 de junio, las representaciones de las comunidades afectadas por las
actividades de Glencore, Chevron, Shell y Coca-Cola, entre otras, presentaron
casos que demuestran las violaciones graves a los derechos humanos cometidas
por las empresas transnacionales (ETN). Los casos reflejan un patrón de
violaciones sistemáticas del acceso a la justicia de las víctimas de
persecución, intimidación, asesinato y destrucción del medio ambiente por parte
de las ETN. </span></p><p class="MsoNormal" style="margin:0in 0in 0pt"><font face="Times New Roman" size="3">

de valorar todos los testimonios, el jurado de expertas y expertos presentó una
declaración en la cual recomienda la puesta en marcha de mecanismos que juzguen
los abusos de las ETN, específicamente: la adopción de normas vinculantes para
las empresas transnacionales, la implementación de un Tribunal Económico
Internacional y un Centro Público de ETN. La declaración reconoce los esfuerzos
de varios Estados miembros del Consejo de Derechos Humanos, para poner en marcha
la creación de un tratado vinculante que controle las actividades de las ETN.
Esto es un paso importante que busca poner fin a la impunidad sistémica

ampliamente documentados de todo el mundo, el jurado confirmó que dichas
prácticas no son casos aislados, sino que son parte de un patrón sistemático
global creado y facilitado por un régimen político, económico y jurídico que
protege a las ETN, de las acciones legales iniciadas por las víctimas de los

de la empresa minera anglo-suiza Glencore fue emblemático debido al impacto de

alimentos y agua, y en consecuencia provocaría un descontento social. Debido a
la resistencia del pueblo Bla'an, las fuerzas paramilitares y militares han
sido desplegadas en la zona, lo que ha conllevado al asesinato de líderes
indígenas anti-mineros. La única demanda de los pueblos indígenas es la

Fajardo, líder comunitario de Ecuador, acusó a Chevron-Texaco por la
"contaminación sistemática de la Amazonía ecuatoriana que ha devastado el

of the United Nations Human Rights Council to kick-start a process of building

first step towards ending the systemic impunity that was present in all of the cases

corporation Glencore was emblematic of the global reach of a single corporation.
Testimony from communities affected by the company in Peru, Colombia, Zambia
and the Philippines provided a clear example of how TNCs can operate worldwide
with complete impunity. G</span><span style="font-family:"Calibri","sans-serif";font-size:11pt" lang="PT-BR">illarme
Joy Pelino from the Social Action Center-Marbel, representing the Bla'an
indigenous peoples in the Philippines who have been affected by the t</span><span style="font-family:"Calibri","sans-serif";font-size:11pt" lang="EN-GB">he Tampakan Copper-Gold Project, owned and operated by Glencore
Xstrata, Australian company Indophil and a local subsidiary commented that “the
mining project will directly impact five ancestral domains displacing 4,000 mostly
indigenous people. The mine will damage food and water sources and will eventually
lead to social unrest. Due to resistance from the Bla’an people, military and
para-military forces have been deployed in the area, causing human rights
violations and killings of anti-mining Indigenous Peoples leaders. The people
have no other demand, except for the mining corporations and investors involved
to stop the militarization and put an end to the project.” </span></font></p><font color="#000000" face="Times New Roman" size="3">

June 24, 1979 by Lelio Basso, lawyer, Senator, and writer, one of the “fathers”
of the Italian Constitution. It is a so-called 'opinion tribunal', inspired by
the experience of the Russell tribunals on Vietnam (1966-1967) and Latin
America dictatorships (1974-1976). It bases its activity on the 1976 Algiers
Declaration on the Right of Peoples. The PPT raises public awareness of legal
shortcomings affecting the marginalised communities and peoples non-recognised
as subjects of rights, in order to provide voiceless victims with a stand of
visibility and a possibility of claim, recognition and remedy of their rights. </font></span></p><font color="#000000" face="Times New Roman" size="3">
