Heidelberg/Madurai, 09.08. 2010 - El gabinete del estado de Kerala ha
establecido un Tribunal de Reclamaciones de Plachimada para repartir
las indemnizaciones de 216,26 rupias crore (aproximadamente 46,2
millones de dólares estadounidenses) de la Compañía de Bebidas
Hindustan Coca Cola por los daños ecológicos que causó en Plachimada,
Kerala.<br>
<br>
La formación de un tribunal fue anunciada el 30 de junio de 2010 con
motivo de las recomendaciones de un Comité de Alto Poder que fue
establecido por el estado de Kerala. El 22 de marzo de 2010, el Comité
había pedido públicamente que Coca-Cola se hiciera responsable de la
suma estipulada. El tribunal juzgará los litigios relativos a la
reparación del daño provocado por la planta embotelladora de la empresa
en Plachimada y otros pueblos cercanos. La suma está destinada a
compensar a los residentes de Plachimada por las pérdidas derivadas en
agricultura, los problemas de salud y la pérdida de salarios, entre
otras cosas. La planta en el distrito de Palakkad se cerró en marzo de
2004 tras una orden del Tribunal Supremo y las continuas protestas de
los residentes de Plachimada. FIAN apoyó estas protestas con una Acción
Urgente en 2003, pidiendo respeto a los derechos de los agricultores en
el acceso al agua y la alimentación.<br>

En 1988, la compañía Coca-Cola estableció una fábrica cerca de la aldea
de Plachimada, en el estado indio de Kerala. La planta estaba
produciendo 85 camiones cargados de bebidas por día, cada uno con
550-600 cartones de 24 botellas de 300 ml. Con el fin de cubrir las
necesidades de agua para esta producción, la empresa excavó varios
pozos profundos en la tierra comprada por la empresa, tradicionalmente
agrícola. Antes de la adquisición de la tierra de agricultores privados
y la conversión de los mismos en un polígono industrial, la comunidad
local, en su mayoría personas indígenas, dependían de la tierra para
sus medios de subsistencia como jornaleros agrícolas. La empresa
extrajo alrededor de 1.500.000 litros de agua al día. El uso de estas
enormes cantidades de agua dio lugar a un agotamiento de las aguas
subterráneas. Otros agricultores a pequeña escala o marginalizados no
pudieron usar sus bombas durante el tiempo suficiente para regar sus
campos, lo que llevó a una disminución de su cosecha - y la
subsiguiente denegación de trabajo asalariado a los jornaleros
agrícolas indígenas y sin tierra. El proceso de producción de la
fábrica no sólo condujo a una peligrosa escasez de agua, sino también a
la contaminación de las fuentes locales de agua debido a la emisión de
metales tóxicos como el cadmio y plomo salino. Como consecuencia,
alrededor de 1000 familias indígenas sin tierra, que dependen del
trabajo asalariado agrícola, se vieron afectadas.<br>

Después de una campaña bajo el nombre Comité para la lucha Plachimada"
(Plachimada Struggle Committee) que alertó al gobierno del estado y
atrajo una significativa atención internacional de los defensores de
los derechos humanos, trabajadores sociales y activistas del desarrollo
en el estado de Kerala formaron una coordinadora llamada "Comité de
Solidaridad de Plachimada" (Plachimada Solidarity Committee). FIAN ha
estado estrechamente vinculado y capacitando al Comité para la lucha
Plachimada".<br>

La fábrica de Plachimada se cerró en 2004. Además de cerrar la planta,
el Adivasi Samrakshana Sangham, el grupo principal del Comité para la
lucha Plachimada y el Comité de Solidaridad de Plachimada presentaron
una demanda de indemnización al gobierno del estado de Kerala. Pidieron
una compensación de al menos 48 millones de dólares estadounidenses
para los agricultores de la región. La reciente designación de un
tribunal por el gobierno de Kerala se anunció durante el caso pendiente
de Bebidas Hindustan (filial de Coca Cola S.A.) que buscaba poder

constitution
de
ce tribunal a été
annoncée le 30 juin 2010 sur recommandation du Comité de Haut Pouvoir
établi
par l’Etat du Kerala. Le 22 mars 2010, le Comité avait publiquement
demandé que
Coca Cola assume le paiement de la somme mentionnée. Le tribunal se
prononcera
sur les litiges relatifs à la réparation du dommage causé par l’usine
d’embouteillage de la compagnie à Plachimada ainsi que dans les
villages
voisins. L’argent servira à indemniser les habitants de Plachimada
notamment
pour les pertes enregistrées en agriculture, pour les problèmes de
santé et la
perte de revenus. L’usine du district de Palakkad avait été fermée en
mars 2004
sur ordre du Tribunal Suprême suite aux protestations continues des
habitants
de Plachimada. FIAN avait appuyé les protestations par une action
urgente
lancée en 2003 qui réclamait que soit respecté le droit d’accès à l’eau
des
agriculteurs afin qu’ils puissent se nourrir eux-mêmes.<o:p></o:p></span></strong></h2>
<h2 style="text-align: justify;"><strong><span

1988,
<st1:personname productid="la compagnie Coca Cola" w:st="on">la
compagnie Coca Cola</st1:personname>
avait construit une usine près du village de Plachimada, dans l’Etat du
Kerala
en Inde. De l’usine sortaient quotidiennement 85 camions qui
transportaient
chacun entre 550 et 600 caisses de 24 bouteilles de 30 cl. Pour couvrir
ses
besoins en eau, la compagnie avait creusé plusieurs puits profonds dans
les
terres agricoles qu’elle avait achetées. Avant l’achat de ces terres à
des
privés et leur conversion en polygone industriel, la communauté locale,
majoritairement tribale, dépendait de la terre pour sa subsistance en
tant que
travailleurs agricoles. La compagnie pompait près de un million 500
mille
litres d’eau par jour, ce qui conduisit à l’épuisement des eaux
souterraines.
L’eau vint aussi à manquer à des petits paysans : ils ne parvenaient
plus
à irriguer suffisamment leurs champs, ce qui entraîna une diminution de
leurs
récoltes et l’incapacité de donner du travail salarié aux journaliers
tribaux
sans terre. Le mode de production de l’usine entraîna non seulement un
manque
d’eau mais aussi la pollution des sources par des métaux toxiques tels
que le
cadmium et les sels de plomb. Près de mille familles indigènes sans
terre qui
dépendaient d’un travail agricole salarié furent touchées.<o:p></o:p></span></strong></h2>
<p class="MsoNormal" style="text-align: justify;">Une campagne menée
par la communauté sous le nom de
« Comité de lutte Plachimada » alerta le gouvernement de l’Etat et
attira l’attention au niveau international. Des défenseurs des droits
de
l’Homme, des travailleurs sociaux et des acteurs du développement de
l’Etat du
Kerala formèrent une coordination dénommée « Comité de solidarité de
Plachimada ». FIAN a eu des liens très étroits avec le « Comité de
Lutte de Plachimada » et leur a donné des formations.<span style=""> <br>

tribunal was announced on 30 June 2010 on the recommendations of a High
Power
Committee that was established by the state of Kerala. On March 22,
2010 the
Committee had publicly demanded that Coca-Cola beheld liable for the
stipulated
sum.. The tribunal will adjudicate disputes relating to compensation
for the
damage the company's bottling plant caused in Plachimada and other
villages in
vicinity. The sum is meant to compensate Plachimada residents for
agricultural
losses, health problems and loss of wages, among other things. The
plant in
Palakkad district was closed in March 2004 following a high court order
and
continuous protests by Plachimada residents. FIAN supported these
protests with
an Urgent Action in 2003, asking to respect the rights of the farmers
for their
access to water to feed themselves. <br>

<o:p></o:p></span>
<p class="MsoNormal" style="text-align: justify;"><span style=""
lang="EN-GB">In1988,
the Coca-Cola Company had set up a factory near the <st1:place
w:st="on"><st1:placetype w:st="on">village</st1:placetype> of <st1:placename
w:st="on">Plachimada</st1:placename></st1:place>
in the Indian state of Kerala. The plant was producing 85 truckloads of
beverages
per day with 550-600 cases, each containing 24 bottles of 300ml. In
order to
cover the water needs for this production, the company dug several deep
bore-wells on the traditional agricultural land that were purchased by
the
Company. Previous to the purchase of the land from private farmers and
conversion of the same into an Industrial Campus, the local village
community,
in their majority indigenous tribal people, depended on the land for
their
livelihood as agricultural coolies (wage earners). The Company
extracted about <st1:metricconverter productid="1,500,000 liters"
w:st="on">1,500,000 liters</st1:metricconverter>
of water every day. The use of these immense amounts of water led to a
depletion of ground water. Other small and marginal local farmers were
unable
to run their pumps long enough to water their fields, which led to a
decline in
their harvest and subsequent denial of wage employment to the tribal
landless
agricultural coolies However, the factory's production process not only
led to
a dangerous water shortage, but also to a contamination of the local
water
sources due to the release of toxic metals such as cadmium and lead
saline. As
a consequence, around 1000 landless indigenous families who are
dependent on
agricultural wage labor were affected. <br>

Plachimada factory was shut down in <st1:metricconverter

to closing down the plant the
Adivasi Samrakshana Sangham core group of Plachimada Struggle Committee
and the
Plachimada Solidarity Committee submitted a demand for compensation to
the
state government of Kerala. They requested that a compensation of at
least

dollar be paid to the farmers of the region. The recent appointment of
the
tribunal by the Kerala Government is announced during the pendency of
the case
filed by Hindustan Beverages subsidiary of Coca Cola Inc seeking orders
to
